Madoff victims trade on trustee's gains and losses

(Reuters) - After Bernard Madoff's fraud unraveled in late 2008, Yale Fishman was courted by Wall Street traders seeking to buy his claim to assets that could be recovered from the mess. After three years of ignoring their calls, he finally said yes.

Fishman, an estate planner in Woodmere, New York, and a former Madoff investor, cut a deal with a trading firm to sell part of his bankruptcy claim in the long-running case. He said he sold his $1.1 million claim for $800,000, or about 73 cents on the dollar, in late December.

"I held it for a while, but they keep calling you up and soliciting you," he said. "And I figured I should sell it because I was planning for my kids," said Fishman, whose sale could not be independently verified.

As in many bankruptcies, the collapse of Madoff's financial empire spawned a mini-market of trading in the rights to any potential recoveries. Bankruptcy claims trading in the Madoff case has moved in fits and starts since Madoff was arrested, with claims currently trading in the range of 60 cents on the dollar, according to levels quoted by traders.

Recent setbacks by the court-appointed trustee trying to recoup assets on Madoff victims' behalf - combined with frustration over the trustee's legal and other fees, which to date total more than $550 million and counting - are encouraging some former Madoff customers to unload their claims. Most original Madoff claims sellers are ordinary investors, not the lenders, debt holders or vendors who are the typical sellers in other claims-trading situations.

A bankruptcy claim is essentially an IOU that gives the holder the right to a portion of any assets later recovered. The seller gets cash upfront rather than potentially waiting years for a payback, while the buyer - typically a hedge fund or bank - pays a discount to the face value of the claim in hopes of ultimately recouping more.

Claims trading has long been a Wall Street niche. Past examples of significant claims-tradings markets include those stemming from the collapse of Enron Corp. and Lehman Brothers Holdings Inc. More recently, buyers have been snatching up MF Global Holdings Ltd customer claims.

While claims trading is always a bet on the value of the bankrupt estate, trading in Madoff claims has become almost a pure bet on what the trustee, lawyer Irving Picard, can recover through his myriad court battles.

So far, Picard has won settlements of $9.1 billion through lawsuits against groups and individuals he has accused of turning a blind eye to Madoff's crimes and profiting from his scheme. Much of that money is tied up in litigation over payout calculations, however, and cannot be distributed. So far, Madoff investors have only received payments of $330 million.

Picard's office has said Madoff customers ultimately could get a full recovery of the more than $17 billion in approved claims. Picard spokeswoman Amanda Remus declined to comment on claims-trading activity or prices.

Remus said the trustee and his legal team have gotten "an extraordinary result" through their work "in reconstructing from nothing the facts and scope of the Madoff fraud and achieving record recoveries." She also said the trustee's fees are paid through funds from the Securities Investor Protection Corp., a nonprofit group that charges fees to broker-dealers, not from recoveries intended for Madoff victims.

It's unclear how many Madoff investors have sold their claims, or at what prices. Because Madoff's firm, Bernard L. Madoff Investment Securities LLC, was unwound under the auspices of SIPC instead of through a Chapter 11 bankruptcy, there is no legal requirement for claims trades to be made public.

Bankruptcy claims trade in an over-the-counter market made up of small brokers who specialize in finding claims and traders from broker-dealers such as the Seaport Group, CRT Special Investments LLC and Macquarie Group. They call and send emails to potential buyers about the price and size of claims being bought and sold, meaning there are no official price quotes.

Buyers of Madoff claims have included Deutsche Bank and hedge funds Fortress Group, Monarch Capital and Silver Point Capital, according to traders involved in the transactions. Fortress did not respond for comment, while Deutsche, Monarch and Silver Point declined to comment.

PICARD'S EFFORTS

Picard's efforts to recover funds have included lawsuits against an array of banks, wealthy individuals and Madoff family members.

The defendants, who include Madoff's brother, Peter, and son Andrew, have countered that they, too, were betrayed by Madoff and that the trustee waited too long to bring some of his claims. Picard expanded his lawsuit, filed in U.S. Bankruptcy Court in Manhattan, against the family members earlier this month to $255 million, from $226 million.

In one of his earliest and biggest successes, Picard won approval in January 2011 of a $7.2 billion settlement with Madoff investor Jeffry Picower. Optimism among traders grew that the payback for claims holders would be large, and Madoff claims at that point traded above 70 cents on the dollar, according to traders who have tracked the prices.

"People thought he was going to roll through this," Joseph Sarachek, managing director at CRT, said of Picard.

Then, in September 2011, the trustee sustained some big setbacks, triggering a drop in claims prices to the mid-50-cents-on-the-dollar range, according to traders. U.S. District Court Judge Jed Rakoff in New York ruled that Picard could only reach back to the last two years of the fraud in pursuing his "clawback" lawsuits against Madoff customers who withdrew more money from their accounts than they had deposited.

The judge was considering whether Picard could seek funds from New York Mets owners Fred Wilpon and Saul Katz, who were investors with Madoff, and the ruling limited the trustee's potential recoveries. The Mets owners later settled litigation brought by the trustee.

In November, another federal judge in Manhattan threw out most of the trustee's nearly $20 billion lawsuit against JPMorgan Chase & Co and a $2 billion case against UBS AG .

Trading in Madoff claims can be thin, and prices have bounced around sharply, according to market participants. Fishman, the Madoff victim who sold a claim in December, said he executed his trade when prices climbed from earlier levels. Since then, prices have settled to around 60 cents on the dollar, said Robert Gallivan, a senior managing director at Macquarie.

But none of these price movements or legal developments matter much anymore to Madoff investors who have shed their claims. Selling the claims has given some victims, who had entrusted their life savings to the man they thought was a financial genius, a measure of closure.

"I think people understand as time goes on that this is not a fast process," said Burt Ross, a Madoff victim in Malibu, California, who said he sold his claims some time ago.

At Galilee Caviar in Kibbutz Dan, Israel, there are pools of sturgeon everywhere you look. The massive fish aren't much to look at ? they look like a cross between a seal and a catfish. But they demand a high price ? about $2,500 each, says Yigal Ben Tzvi, the owner of the company.

The fish are reeled in by net, and then anesthetized in smaller tanks. Biologist Avshalom Hurvitz sits at a small white table, gingerly pulling back tissue with a scalpel to show us what's inside.

"These are the eggs, and they are 3 millimeters in diameter. They have a pale gray color, which is nice. I see no fat tissue here. It means that the yield of caviar will be high," Huvitz says.

As Huvitz pronounces the caviar Grade A, Ben Tzvi smiles. He's proud of the fact that chefs like Eric Ripert serve his caviar exclusively in their restaurants. Ben Tzvi says his caviar is superior because of the mountain spring water in the ponds and the purebred nature of his fish.

"The price in New York, somebody calculated, is $9,400 per kilo," Ben Tzvi says. (Gourmet shop Dean & DeLuca sells 8.8 ounces of the stuff online to the rest of us for just under a cool $1,000.)

Ben Tzvi says he never set out to become a purveyor of caviar. Kibbutz Dan was at the forefront of fish farming in the early 1980s and the 1990s. The caviar business is a subsidiary of Dan Fish Farms. But as the kibbutz shifted from its socialist structure to a privatized model, Ben Tzvi and others explored new business opportunities.

At first, they tried half a dozen fish before settling on sturgeon, imported from Russia as fertilized eggs. "For the first 10 years we grew them for meat, 'cause no one thought of caviar at that time," Ben Tzvi says.

Historically, the world's best caviar came from Russia and Iran. But overfishing of sturgeon in the Caspian and Black Seas has brought the fish to the brink of extinction, and severe quotas cap the legal sale of caviar from those countries now.

By the early 2000s, world caviar prices were rising sharply, and international authorities tried to crack down on fraud by implementing a labeling system.

Ben Tzvi decided to give farmed caviar a try. A few years later, when he started selling his product, the price doubled. Then it tripled. Now 99 percent of the world's caviar comes from fish farms like Ben Tzvi's.

In February 2010 Sir Richard boosted the Tories by calling for public spending cuts to start that year.

The high-profile entrepreneur said the UK?s huge borrowing was a serious risk to the UK economy and action could not be put off.

George Osborne, then shadow chancellor, said at the time that Sir Richard?s support was hugely welcome. ?As Britain?s best-known entrepreneur, he knows more about creating jobs and building an economic recovery than the entire Labour Cabinet put together,? he added.

But Sir Richard now wants the Government to focus on making it easier to set up a business in the UK by reducing business rates and regulation on small and start-up companies.

He suggested politicians look at policies including a national insurance holiday on hiring people for the first two years.

And he wants to introduce school lessons on basic business and money-management skills to create a new generation of business owners.

Sources close to the singer tell TMZ what we were hearing this morning -- that Donna was in New York City during 9/11, living at an apartment near Ground Zero.

Donna became almost paranoid about breathing the air, which was heavy with a rancid odor.

In the months and years following 9/11, Donna's feelings intensified. One source tells us when he was around Donna, she would constantly spray some sort of disinfectant in the air. Deney Terrio, the host of "Dance Fever," tells us ... when he was around Donna post 9/11, she would hang silk sheets in her dressing room to prevent dust from coming in.

And one source says ... Donna, who was a fervent practicing Christian, believed 9/11 was an attack on Christianity and in some metaphysical way Christians like her were targets. She somehow felt that her illness was a byproduct of the attack.

And, we're told, after Donna was diagnosed with lung cancer, several people told her that cigarette smoke may have been the culprit -- she was a smoker, and she also frequented clubs where people smoked. But Donna simply didn't buy it. - more on this story

Daniel R. Schwarz: What Is the Cultural Significance of Facebook's May 18, 2012 IPO?

Worrying about the fluctuating price of Facebook and whether Morgan Stanley properly managed the IPO misses the major historical and cultural point of what happened. What, we should be asking, is the significance of Facebook's opening capitalization (number of shares times price of shares, originally $38) at over $100 billion when the iconic New York Times Company -- which owns the New York Times as its flagship product -- is capitalized at less than one billion?

Given that Facebook's original capitalization -- making it on May 18, 2012, the 23rd largest U.S. corporation -- is as much a predictor as a reflection of value, does this mean that investors are voting with their feet and fleeing traditional media for social media because they foresee not only the end of the print paper but the inability of the Times to sustain itself as a news source? While the average stock S&P price is $14 for every $1 of profit, Facebook's shareholders paid $100 for each dollar of profit. (Even today, May 27, 2012 with a price decline to slightly under $32 a share and capitalization of over $87 billion, it is still in the top 30 largest corporations.) By contrast, it is not clear if the Times Company is on the road to profitability.

I am less interested in the business model than the value our culture is putting on what is still perhaps the most important news gathering institution in the world -- versus the value it is placing on a social media company. For more than one hundred and fifteen years, the New York Times has been, not without bumps such as the misreporting of WMD's, our best diary of how our history unfolded day by day.

In an important way, Facebook is the anti-Times. The concept of the newspaper as paper of record also implies gatekeeping by which I mean that the editors decide what goes through the Informational Gates into the daily print paper and Internet site, nytimes.com. In his column in the May 20, 2012 Sunday Times, Thomas Friedman seems to quote with approval Amazon.com's founder, Jeff Bezos, who advocates "eliminating all the gatekeepers."

But do we really want the death of gatekeeping? Within a democracy, we want forums for diverse views and much can be said for interactive media with audience comments. But we also need accurate and objective news and that depends on editors and reporters selecting and arranging available information. More than any other news source in the United States, the Times -- with its 26 foreign bureaus and experienced news staff -- provides foreign news. No doubt some independent bloggers are informed, and op-ed pages and major sites like The Huffington Post should include them in a dialogue. But that is different from ceding major foreign news to bloggers who not only don't know the languages and histories of the places they discuss but also have never visited those countries or interviewed key political figures. (In regard to gatekeeping, we might also note that authoritative historical and scientific books and articles also depend on knowledgeable editing and vetting).

If the blogosphere undermines the concept that editors control those Informational Gates, Facebook takes this even further by assuming we are interested more in each other's private and personal lives -- what we might call micro-news -- than in international, national and even local news, and that we will spend more time reading about the health of our friend's dog -- the term "friend" is used loosely when many Facebook users have hundreds of friends -- or a minute-by-minute report on what music someone is listening to. One could argue that this information fills different needs, but many of my present and recent former Cornell students -- and these are for the most part gifted students -- spend hours on social media, most of it on their smart phones; by their own admission, this takes time away from being informed.

This interest in the small details of life -- local news defined in its most reductive form --affects the major news-gathering venues that must engage its readers to sell advertising. With its expanded emphasis on its soft sections such as Style, Dining, Home and Travel, the Times today is as concerned with delivering what it thinks its audience and its advertisers want as it is with what it thinks its audience needs to know. This escalation of what the Times calls value added journalism -- where to eat and travel, how to invest and buy a home, how to find a partner -- takes its cue from social media in stressing the details of day-to-day life.

So when we hear that Facebook is worth more than 100 times -- or more than 87 times with the decline in its post IPO price -- what the New York Times Company is worth, we are not only hearing an economic fact but also learning something about the values of our culture. In 2012, we may be more interested in the warp and woof of our daily life -- often fluff rather than substance -- and we may be more motivated by our need to connect with one another on micro-matters rather than to find larger goals and ideals informed by national and international concerns.
