Mo Lawal apologizes for tweet about Nevada commissioner

On "No Holds Barred" radio and later in a video with CSN Bay Area, Mo Lawal apologized to Nevada Athletic Commissioner Pat Lundvall for calling her a slur for women on his Twitter account.

"I was out of line for calling the woman the 'b' word and I was wrong for that," Lawal told CSN California. "I was kind of mad about the comments, I was offended by the comments made towards me and I was out of line. I was too emotional. I apologize for that. With that being said, I still feel that I was offended, but I'm in the wrong for what I said."

Lawal has not changed his stance on Lundvall's tone towards him. In the end, it does not matter if anyone else but Lawal found her questioning racist, because it was directed at Lawal. Based on his experiences in his life, he found it to be racist and was offended, and he has a right to feel that way. Lashing out against Lundvall with that language wasn't the best move, which is why he apologized.

Apologizing was a smart thing for Lawal to do because he can now move on from this incident. It won't continue to hang over his head as he continues to rehabilitate from knee surgery and a life-threatening staph infection.

'Hero' doctor saves babies caught in Romania corruption

Dr. Catalin Cirstoveanu runs a cardio unit with state-of-the-art equipment at a Bucharest children's hospital. But not a single child has been treated in the year-and-a-half since it opened.

The reason?

Medical staff he needs to bring in to run the machinery would have expected bribes.

So Cirstoveanu has launched a lonely crusade to save babies who come to him for care: He flies them to Western Europe on budget flights so they can be treated by doctors who don't demand kickbacks.

That's what Cirstoveanu did last week for 13-day-old Catalin, who needed heart surgery. Cirstoveanu packed a small bag, slipped emergency breathing equipment into the baby carrier and caught a cheap flight to Italy, where doctors were waiting to perform the surgery.


The operation was successful. Two days later, though, a 3-week-old baby that Cirstoveanu whisked away to the same clinic in northwestern Italy ? with tubes piercing her tiny frame ? died before she was able to have lymph gland surgery.

"I was very worried it wouldn't work," said Cirstoveanu. "But in Romania, she would have died anyway."

The soft-spoken Cirstoveanu is fighting an exhausting and largely solitary battle against a culture of corruption that's so embedded in Romania that surgeons demand bribes to save infants' lives and it's even necessary to slip cash to a nurse to get your sheets changed.

It's one of the reasons why the country's infant mortality rate is more than double the European Union average, with one in 100 children not reaching their first birthday.

"To be honest, it's so deeply rooted into our system that it's really difficult to eliminate," Health Minister Ladislau Ritli said in an interview with The Associated Press.

Officially, the new cardio unit that Cirstoveanu runs at the Marie Curie children's hospital isn't functioning because jobs have not been filled. The real reason appears to be that Cirstoveanu has banned staff from taking bribes. That means that high-tech machinery lies idle because qualified experts do not bother to apply for jobs, as they know they cannot supplement their incomes with bribes.

The zero-tolerance policy to corruption makes for a grueling work schedule for Cirstoveanu, who needs to shuttle babies abroad for surgery ? and take care of them on the flight. During the two-hour flight with the girl who died, Cirstoveanu fixed tubes, sedated her and hand-pumped oxygen to keep her alive.

In the less than 24 hours Cirstoveanu had in Bucharest between returning from Catalin's trip and departing with the little girl, he even squeezed in a shift at the Marie Curie clinic.

Endemic corruption
Patients in Romania routinely discuss the "stock market" rate for bribes. Surgeons can get hundreds of dollars and upward for an operation, while anesthetists get roughly a third of that, depending also on what a patient can afford. Nurses receive a few dollars from patients each time they administer medications or put in drips. Getting a certificate stamped to have an operation abroad can easily cost hundreds, if not thousands of dollars if you ask the wrong doctor.

While the Romanian state appears unwilling to do anything, it often ends up footing the bill.

At the Marie Curie unit, Catalin's operation would have cost $2,700 to $4,000 without bribes. Romanian state health insurance is paying 10 times that for his operation in Italy ? a small fortune in a country where the average monthly salary is about $460 after tax.

Many disillusioned doctors have abandoned the country, which spends just 4 percent of its gross domestic product in health care ? about half of the percentage of GDP spent by Western European countries.

Last year, some 2,800 Romanian doctors ? discouraged by the antiquated and corrupt health system and low wages ? left to work in Western Europe, according to the Romanian College of Doctors.

"Ideally, we would have decent salaries and nobody would be tempted to accept informal payments," said the Ritli, the health minister. "And the population would be educated so people would believe that this is not the only way to get proper health care."

Bribes across Romania accounted for some $1 million a day in 2005, according to a World Bank report; more recent estimates are not available. The culture of bribes ? or "informal payments" as they're commonly known ? is tacitly accepted.

But anger is rising. One of Marie Curie's donors, Procter & Gamble, has several times gone back to the hospital and the Health Ministry to ask questions about when the unit will start functioning.

The tragic plight of Romanian children is nothing new.

Communist legacy
In a misguided effort to boost Romania's then-population of 23 million, Communist dictator Nicolae Ceausescu banned birth control and abortion, which led to thousands of infants being left in orphanages in harrowing conditions broadcast around the world after his execution in 1989.

Nearly a quarter-century later, the country's shortcomings are again being seen through the gaze of children and powerless parents trapped in a web of corruption.

For those whose children die shortly after birth, grief is magnified when they do not receive a birth certificate or even see their babies alive. Angela Vasile, whose baby daughter, Cristina, only lived one day, saw her infant just once after she'd died, lying on a metal table.

She was then put in a ward of nursing mothers, adding to her anguish.

Bianca Brad, a Romanian celebrity, spoke out publicly about the pain of losing her baby at birth ? calling the situation "criminal." She founded the "EMMA Association" to help grieving parents, offering support for those who do not receive psychological counseling and remain locked in years of grief.

Yet remarkable things are happening at the Marie Curie Hospital. Cirstoveanu is personally overseeing the survival of Baby Andrei, an 8-month-old Roma baby born to underage parents. His intestines are almost nonexistent.

The tiny infant who weighs about 4.4 pounds with limbs that look like gnarled twigs was given only days to live. His bright eyes, alert gaze and lively personality have endeared him to all staff who comfort him in their arms as much as they can outside of his incubator.

Andrei can only have lifesaving surgery in the United States ? and a fee of hundreds of thousands of dollars is proving prohibitive. Nurses are so fond of the bright boy that they are playing the state lottery in an attempt to raise funds for his surgery.

Even in this grim setting, there are signs that doctors are mobilizing in a bid to make things better.

Anca Mandache, a child heart surgeon, left her career in France to offer her services to the Marie Curie hospital, taking a salary one tenth of what she would have earned there. Others also are expressing an interest in working at the clinic

Cirstoveanu, who also flies sick babies to Germany and Austria, says he feels "ashamed" that he has to go to the lengths he does to save children, but talks with pride of the moment he sees the joy of relieved parents whose babies survive.

They are in awe of his dedication.

"Cirstoveanu is more than a hero ? he is a god for us and the children," said Gheorghe Meliusoiu, Catalin's 28-year-old woodcutter father. "If there were more like him, many lives would be saved."

Om: Meditation a big help for emotional issues

ScienceDaily (Mar. 28, 2012) ? Schoolteachers who underwent a short but intensive program of meditation were less depressed, anxious or stressed -- and more compassionate and aware of others' feelings, according to a UCSF-led study that blended ancient meditation practices with the most current scientific methods for regulating emotions.

A core feature of many religions, meditation is practiced by tens of millions around the world as part of their spiritual beliefs as well as to alleviate psychological problems, improve self-awareness and to clear the mind. Previous research has linked meditation to positive changes in blood pressure, metabolism and pain, but less is known about the specific emotional changes that result from the practice.

The new study was designed to create new techniques to reduce destructive emotions while improving social and emotional behavior.

The study will be published in the April issue of the journal Emotion.

"The findings suggest that increased awareness of mental processes can influence emotional behavior," said lead author Margaret Kemeny, PhD, director of the Health Psychology Program in UCSF's Department of Psychiatry. "The study is particularly important because opportunities for reflection and contemplation seem to be fading in our fast-paced, technology-driven culture."

Altogether, 82 female schoolteachers between the ages of 25 and 60 participated in the project. Teachers were chosen because their work is stressful and because the meditation skills they learned could be immediately useful to their daily lives, possibly trickling down to benefit their students.

Study Arose After Meeting Dalai Lama

The study arose from a meeting in 2000 between Buddhist scholars, behavioral scientists and emotion experts at the home of the Dalai Lama. There, the Dalai Lama and Paul Ekman, PhD, a UCSF emeritus professor and world expert in emotions, pondered the topic of emotions, leading the Dalai Lama to pose a question: In the modern world, would a secular version of Buddhist contemplation reduce harmful emotions?

From that, Ekman and Buddhist scholar Alan Wallace developed a 42-hour, eight-week training program, integrating secular meditation practices with techniques learned from the scientific study of emotion. It incorporated three categories of meditative practice:

  • Concentration practices involving sustained, focused attention on a specific mental or sensory experience;
  • Mindfulness practices involving the close examination of one's body and feelings;
  • Directive practices designed to promote empathy and compassion toward others.

In the randomized, controlled trial, the schoolteachers learned to better understand the relationship between emotion and cognition, and to better recognize emotions in others and their own emotional patterns so they could better resolve difficult problems in their relationships. All the teachers were new to meditation and all were involved in an intimate relationship.

"We wanted to test whether the intervention affected both personal well-being as well as behavior that would affect the well-being of their intimate partners," said Kemeny.

As a test, the teachers and their partners underwent a "marital interaction" task measuring minute changes in facial expression while they attempted to resolve a problem in their relationship. In this type of encounter, those who express certain negative facial expressions are more likely to divorce, research has shown.

Some of the teachers' key facial movements during the marital interaction task changed, particularly hostile looks which diminished. In addition, depressed mood levels dropped by more than half. In a follow-up assessment five months later, many of the positive changes remained, the authors said.

"We know much less about longer-term changes that occur as a result of meditation, particularly once the 'glow' of the experience wears off," Kemeny said. "It's important to know what they are because these changes probably play an important role in the longer-term effects of meditation on mental and physical health symptoms and conditions."

The study involved researchers from a number of institutions including UCSF, UC Davis, and Stanford University.

This process is often termed the ?neoliberalization? of higher education by its critics and has resulted in universities taking on the feel and function of large for-profit corporations complete with highly-paid senior administrators who demand economic rather than humanistic justification for the actions of faculty. ?It has also brought about the relentless pursuit of worker productivity through technology, precarious labor, and the standardization of administrative and classroom practices.? As insightful as these critics of the neoliberal academy have been in pointing out many of the causes and negative effects of the neoliberalization of higher education, they are virtually silent about the role the academic laborer has in fostering the process (Aronowitz, 2000; Giroux, 1983; Giroux and Giroux, 2004; McLaren, 2005).? This blind spot inhibits them from developing a coherent strategy for resisting the intensification of harmful neoliberal practices.

Critics of the neoliberalization of public universities often view the encroachment of a free-market ethos into higher education as being exogenously imposed on the university by capitalist forces seeking to better control academia, and students? minds for their own gain.? In addition, these critics often see themselves as individuals trying to hold back the rising tide of neoliberal oppression that is turning their workplace from an institution of scholarly pursuits to an assembly line churning out ?knowledge? and ?knowledge workers? for the ?knowledge economy?.? So far, their best strategy for resisting the privatization of public education has been to create awareness through the publication of research and analysis in journals, books, and conference presentations that shows the detrimental effects this is having on the academy and society (Saunders, 2010). ?Since these critics assume that they are not complicit in this process, they believe that they have little or no options to resist or reverse it, outside of analyzing its impacts and lamenting its inevitability.? I disagree.? I believe that academic staff (professors, lecturers, and teaching assistants) are not objects within the neoliberal university.? Instead, they are an integral part of the neoliberalization of public education through the practice of grading, and as such can use grading, or more specifically not grading, as an enormously powerful tool to resist the further imposition of neoliberal practices on public higher education.

Grading has become the core function of the modern system of higher education.? Nearly every process in the university relies on grades from matriculation, class enrollment, financial aid, and graduation, to departmental accreditation and a school?s reputation.? University administrators particularly fret about ?grade inflation? and its impact on their school?s or department?s reputation of academic rigor.? Increasingly, employers are looking at not just a student?s degree but also their transcripts to determine whether they would be suitable employees (Iacus and Porro, 2011). ?In addition, the heavy emphasis on grades by institutions of higher education and private and public sector employers have caused students? to fetishize the grade to the detriment of learning.? It is safe to say that if the academic staff, whom are most in control of the grading process, took a principled stand and refused to grade, the current system that values the measurable outcomes of classroom activity because it cannot measure the valuable learning that should go on in a university*, would be disrupted.

Those who currently teach in the university are fostering neoliberalism on public university and college campuses by creating classroom environments that mimic the non-democratic workplace championed by union-busting corporations and politicians.? By enforcing a hierarchy between teacher and student, fostering competition between students, using the coercive measures to ensure obedience, and discouraging creativity and critical thought (all practices inherent in the practice of grading) academic staff are complicit in the neoliberalization of higher education.? This is problematic for two reasons.? First, critical pedagogical and andragogical theory and research demonstrates that this type of environment is antithetical to learning (Flecha, 2000; Johnston, 2004). ?People learn better when they are in a collegial atmosphere where they can make mistakes or voice their thoughts without fear of being punished or admonished (Simon, Bellanca, Bailey, and National Center for Grading/Learning Alternatives, 1976).

Second, in addition to being a tremendous detriment to student learning, grading is also problematic because it opens up the practice of teaching and learning to the rhetoric of neoliberal capitalism (Elton, 2010).? This puts pedagogues at a significant disadvantage in defining the function of higher education.? While many academic workers eschew the stultifying goals of standardized measurable outputs imposed by career administrators, they often reify them by perpetuating the same practices in their classrooms.? By demanding rigid adherence to a set of predefined criteria and punishing those that do not meet these narrow parameters with low or failing grades, faculty are perpetuating the same obedience to hierarchy that is the benchmark of neoliberalism.

The contradiction is not lost on establishment media.? A recent article in the New York Times began ?[g]rades are the currency of education? and proceeded to chastise the hypocrisy of teachers? colleges for assigning grades to their students but not wanting to be graded themselves (Gabriel, 2011).? Portraying university faculties like petulant students, the piece continues ??many of the schools are unhappy, marching to the principal?s office to complain the system is unfair?. This speaks volumes to the contradiction of faculty that perpetuate the audit culture, which in turn supports a neoliberal university, while simultaneously eschewing the same structures they place on students.? When it comes to their ability to teach and research, faculty members often recognize the detrimental impacts of standardization.? However, when it comes to student learning this lesson is often forgotten.? Or perhaps many of them see grading as ancillary to their teaching or a necessary evil and, as a result, fail to recognize the corrosive effect it has on students, their own teaching, and the narrative that the university is a place of learning not training.? If faculty members want to resist the encroachment on their academic freedom that has resulted from the increased standardization of their work environment they should not reify the tools being used against them.

Therefore, to create a space for a non-economic rationale of publicly funded higher education, I propose that academic staff stop grading students.? A job action that results in the refusal to assign grades to students would go a long way to asserting the position of academic staff to define the role of higher education in society.? A movement such as this that sees faculty either refusing to grade students, assigning all students who register in their course top marks, or, my choice, allowing students to grade themselves based on their own assessment criteria would allow academic staff to take greater control of their workplace.

First, it would free teachers to teach, or facilitate learning, instead of being classroom managers.? Instead of the Kafkaesque task of penalizing students for their perceived failures we could spend more of our energy and time providing constructive feedback that would actually be helpful to students.? In addition, we would spend less time preparing tedious multiple choice exams or marking redundant essays and more time producing ludic learning exercises that stimulate students? interest in a subject.? It would also eliminate the odious and soul-crushing moments when students ask questions about their marks as opposed to the material being discussed in class.

Next, eliminating grading from the classroom would contribute to a learning environment free of extrinsically imposed competition and coercion.? The coercion inherent in the practice of grading does not motivate students to engage with course material rather it causes the students to loose their intrinsic joy for learning.? Instead of demonstrating to students that the material is so distasteful that they need to be coerced into learning it, we could labor under the more accurate belief that students have an instinctive desire to know more about the subject.? Thus, demonstrating that coercion is antithetical to learning would counter the notion the students are lazy and need to be coerced to productively participate in society.? Not encouraging a competitive, coercive environment in the classroom would go a long way toward producing cooperative, egalitarian spaces of learning that further demonstrate the blatant failings of a neoliberal model of education.

Finally, a refusal to grade students would confront the neoliberal, anti-Humboldtian idea that the university must justify its actions and existence strictly through economic rationale.? Grades have become the linchpin of the accounting culture that pervades higher education.? Unfortunately accountability is never to students but instead to university administrations more interested in the prestige of the university than with the learning, or lack thereof, occurring in the classroom.? By grading students, academic staff are reifying and standardizing the instruments that allow university administrators to hold them accountable for the quantity and quality of the ?knowledge workers? that they are supposed to produce.? Career administrators use data directly related to students? grades to produce macroeconomic rationale to obtain more financial support for the university from corporate funders or corporate-funded politicians.? This in turn reinforces a fallacious feedback loop whereby employers and students believe that the role of the university is to produce knowledge workers.? When this does not happen to the complete satisfaction of employers and their prospective workers, senior university administrators put pressure on faculty to offer courses and content with more direct benefits to the economy and practical applications for the workforce.? Not grading robs administrators of this tool of standardization.? It also operationalizes an alternative to the fallacious assertion that the role of higher education is to use a banking model of learning to train students to enter the workforce (Elton, 2010; Freire, 1970). ?Since employers will no longer be able to utilize university transcripts or degrees to gauge students? obedience to a neoliberal curriculum they will be forced to use extracurricular means to determine a candidate?s suitability for a job.

Demonstrating that learning is something other than the measurable accumulation of knowledge and skills, a grade abolition movement within the academy would challenge the core assumptions about higher education that has evolved to suit a neoliberal agenda that benefits an elite capitalist class.? This means that academic staff would no longer have to justify their existence and their practices in purely economic terms and instead could begin focusing on the humanistic role of public higher education in society (Readings, 1996) while simultaneously providing a better learning environment for students (Connor, 2007).? In other words, refusing to mimic the hierarchy of neoliberal capitalism in the classroom would give academic staff a powerful, consistent position on issues and questions related to the role of higher education in society.

Property tax changes benefit commercial real estate development ...

It's very encouraging to find out that government-initiated reforms accomplish what they intend to do. South Carolina commercial real estate developers in Charleston, and across the state, have noticed the positive impact of recent changes to property tax laws. Many developers have noted that many of the problems that came up during transactions have largely been impacted by the new tax laws.

Last year, the state approved changes to how taxes are assessed at the point of sale for commercial properties and second homes. Prior to the changes, existing tax laws caused significant property tax increases as commercial properties with appreciating values were sold. In some cases, when property tax values climbed, taxes could increase by as much as 25 percent. Oftentimes, tax hikes of that size would disrupt -- even end -- ongoing commercial property transactions. Now, such tax jumps do not occur unless property values have risen by more than 33 percent.

One particular South Carolina developer has noted that these changes have brought several million dollars worth of investments into local communities. In fact, he noted one negotiation during which an investor was hesitant to provide funding largely due to point of sale issues. When the laws changed, many of the investor's concerns were erased. Overall, the developer noted that these changes help to grow the state's economy and provide jobs for those without work.

During major commercial property transactions, there are a number of complications that can arise. Fortunately, a major sticking point in property deals, point of sale, has been addressed by state lawmakers. As a result, Charleston and other South Carolina communities are seeing some of the benefits. On the other hand, some complications that legislation cannot always address, such as title insurance, zoning or access issues, can stall deals that stand to benefit communities. In those cases, the right kind of knowledge and know-how can produce favorable results for those looking to purchase or develop commercial property.

Natural gas prices fall again on supply concerns

(AP) ? Natural gas prices fell again Tuesday amid doubts that consumers, businesses or industry can put a significant dent in the huge surplus of the fuel in the U.S.

Natural gas futures fell 2.3 cents to $2.20 per 1,000 cubic feet after dropping 5 cents on Monday. That's a 10-year low and half of what natural gas was fetching back in July. Oversupply and mild winter weather have contributed to the plunge.

Any money that consumers are saving on natural gas may be going into the gasoline tank. The national average for regular gasoline in the U.S. is $3.90 per gallon. It's risen 17 cents in March and 62 cents since Jan. 1.

A private research group said Tuesday that a widely watched barometer of consumer confidence barely budged in March as high pump prices helped offset good news in the stock market. Since Jan. 31, the national average for gas has either risen or been unchanged on 53 of 56 days.

Meanwhile oil prices were down slightly. Benchmark U.S. crude oil fell 14 cents to $106.90 per barrel. In London, Brent crude for May delivery fell 45 cents to $125.20 per barrel on the ICE Futures exchange.

Oil prices remain high because of ongoing tension over Iran's nuclear program. Oil has jumped from $75 a barrel in October because of concern that a military strike by Israel or the U.S. against Iran's nuclear facilities would disrupt global crude supplies.

Natural gas supplies are currently more than 50 percent above the five-year average for this time of year. That's due to a boom in production in Pennsylvania, Ohio, Texas and others states. Warmer than usual temperatures this winter also meant homeowners used less natural gas for heating than in years past.

Shiyang Wang, an analyst at Barclays Bank PLC, said in a research report that the market has turned its attention to whether the surplus gas in storage could be absorbed by hot summer weather and utilities opting to use cheap gas for power generation instead of coal. If storage is still abundant as summer ends, prices could remain low in October and November, the analyst said.

In other energy trading, heating oil fell 2 cents to $3.21 per gallon and gasoline futures dropped 3 cents to $3.39 per gallon.

The Case-Shiller home price index report is reporting tepid single-family home sales for January. Prices dropped by a more than expected 0.8 percent, killing any chance of continuing yesterday?s rally this morning.

Though Federal Chairman Ben Bernanke is scheduled to speak in about three hours. So, he could sneeze and tank the market for the day, or he might burp and send the Dow soaring.

I guess it all depends on the jittery investors and if their skies happen to be falling this morning and the March consumer-confidence report later today.
